LABOR LAWS & WORKER PROTECTION

Federal laws require employers to act fairly and protect the health of employees. The U.S. Department of Labor (DOL) administers and enforces more than 180 federal laws. These mandates and the regulations that implement them cover many workplace activities for about 150 million workers and 10 million workplaces.

Following is a brief description of many of DOL's principal statutes most commonly applicable to businesses, job seekers, workers, retirees, contractors and grantees. This brief summary is intended to acquaint you with the major labor laws and not to offer a detailed exposition. For authoritative information and references to fuller descriptions on these laws, you should consult the statutes and regulations themselves.

OSHA WORKPLACE WELLNESS-SAFETY

A safe workplace is sound business
The Recommended Practices are designed to be used in a wide variety of small and medium-sized business settings. The Recommended Practices present a step-by-step approach to implementing a safety and health program, built around seven core elements that make up a successful program.

The main goal of safety and health programs is to prevent workplace injuries, illnesses, and deaths, as well as the suffering and financial hardship these events can cause for workers, their families, and employers. The recommended practices use a proactive approach to managing workplace safety and health. Traditional approaches are often reactive –that is, problems are addressed only after a worker is injured or becomes sick, a new standard or regulation is published, or an outside inspection finds a problem that must be fixed. These recommended practices recognize that finding and fixing hazards before they cause injury or illness is a far more effective approach.

The idea is to begin with a basic program and simple goals and grow from there. If you focus on achieving goals, monitoring performance, and evaluating outcomes, your workplace can progress along the path to higher levels of safety and health achievement.

Employers will find that implementing these recommended practices also brings other benefits. Safety and health programs help businesses:

  • Prevent workplace injuries and illnesses

  • Improve compliance with laws and regulations

  • Reduce costs, including significant reductions in workers' compensation premiums

  • Engage workers

  • Enhance their social responsibility goals

  • Increase productivity and enhance overall business operations

Preventative educational training on Occupational Health &  Wellness is specifically crafted to individual industries and fields, is invaluable to any private business, nonprofits and community based organizations, by presenting preventative workplace wellness education.

AMERICAN DISABILITY ACT

The Americans with Disabilities Act (ADA) is a federal civil rights law that prohibits discrimination against people with disabilities in everyday activities. The ADA prohibits discrimination on the basis of disability just as other civil rights laws prohibit discrimination on the basis of race, color, sex, national origin, age, and religion. The ADA guarantees that people with disabilities have the same opportunities as everyone else to enjoy employment opportunities, purchase goods and services, and participate in state and local government programs.

Workers' compensation will pay for the medical treatment of an injury or illness if:

  • The injury occurred at work or the disease or illness is job-related; and

  • The worker's employer has workers' compensation insurance or is certified by the Texas Department of Insurance, Division of Workers' Compensation to self-insure.

Workers' compensation will also replace some of the worker's lost wages if:

  • The injury or illness caused the worker to lose some or all income for more than seven days.

Texas employers may choose whether or not to maintain workers' compensation insurance. Employers who choose to have insurance may:

  • Purchase insurance policies from private insurance companies; or

  • Self-insure, if they meet the requirements of the Texas Workers' Compensation Act and are certified by the Texas Department of Insurance, Department of Workers' Compensation.
